What Is Mediation?

Mediation is an alternative way to resolve disputes through negotiation with a neutral, qualified mediator chosen by the parties, without going to court.

Mediation is a voluntary dispute resolution method carried out with the participation of an impartial and independent third party with specialist training, who brings the parties together to meet and negotiate, applies systematic techniques and establishes a communication process between them so that they understand each other and produce their own solution.

As its definition shows, mediation is a mechanism based on voluntary participation and mutually agreed solutions. However, it can be made a precondition for filing suit in certain matters. This does not mean the right to go to court is lost. It only means that in certain disputes the parties must first apply to a mediator before going to court.

In Which Disputes Is It Mandatory?

  • Employee receivables and compensation claims and reinstatement lawsuits between employees and employers (since January 1, 2018)
  • Commercial lawsuits concerning receivables and compensation claims for the payment of a sum of money (since January 1, 2019)
